Kratom Legislation in Alabama

As a natural product, kratom has a long and complex history from its early use in Thailand and other parts of Southeast Asia. Beginning in the middle of the 19th Century, the tropical tree gained popularity for its analgesic properties as part of traditional medicine. It gained the attention of people in the United States a decade ago, particularly for those people who were looking for an alternative to the pharmaceutical remedies prescribed for common conditions.

As the country dealt with the elevation of kratom in the public eye, each state began to experience the effect the natural product had on its populace and considered its legality and use.


Kratom In Alabama


It is hard to pin down the exact timeframe that kratom usage became more prevalent in the state of Alabama, but many users point to being able to obtain kratom online at different websites as key. Kratom also became steadily available for purchase at convenience stores and gas stations around the state, with its billing as an herbal supplement in some cases.

It was sold in powder form, which those who used it would often combine with a drink. There were also vendors who sold it in pill form and as the core of a liquid product. According to accounts from the Alabama District Attorneys Association Deputy Director Barry Matson, the number of those using kratom in Alabama spiked in the latter half of 2015 and into early 2016 in certain parts of the state.

At that point, there weren’t any recorded kratom arrests in Alabama, however, officials did share the same concerns over kratom that the federal government has expressed. Since it became more available for purchase and consumption across Alabama and the country, it became clear that paying attention to and ensureing for the quality of active ingredients in kratom was important to maintain safety.


Is Kratom Illegal In Alabama?


In May 2016, Governor Robert Bentley signed a bill brought before him that declared two alkaloids found in kratom, mitragyine and hydromitrgynine, to be banned. The bill, which was sponsored by State Senator Robert Orr, R-Decatur designated these alkaloids as Schedule I controlled substances in accordance with the federal classification.

This effectively made kratom illegal to purchase and possess in the State of Alabama. It is also illegal for any stores or independent vendors to sell kratom or any derivatives in Alabama under the new bill. The bill stipulates that doing so would be considered a Class D felony which carries a penalty of a year and five days of imprisonment.

This decision made the state one of six others in the nation that have currently banned kratom. Alabama has since continued to crack down on those who still produce products claiming to have kratom as an ingredient, as these "kratom-containing" products are becoming more widespread than kratom in its natural form was prior to the bill’s passage.

Advocates are still petitioning the state legislature to reconsider the ban in light of research that’s taking place nationwide exploring the positive benefits of kratom, with support from a number of medical professionals. This, combined with the saftey concerns over the continue marketing of "kratom-containing" products in Alabama may push the state to reconsider its regulatory and legislative positions.
