Georgia Kratom Laws and Issues

Kratom has carved out a niche for itself in the world of natural products that are used for the specific purpose of alternative healing in a world saturated with pills and pharmaceuticals. The product itself has its origins from a tropical tree that is found predominately in Thailand. Centuries ago, Kratom became a go-to analgesic that helped to relieve pain as well as treat digestive issues. It was widely consumed throughout Southeast Asia from the mid-1800’s until authorities deemed it necessary to issue ordinances against its consumption during World War II.

This didn’t deter kratom from becoming a botanical of interest in the West, however, with those in the United States becoming aware of the plant's potential as early as 2010. As this interest grew in the States, the federal government began to recognize that there might be issues with the quality and usage of kratom products. This was reinforced by the rise in cases of users who experienced adverse effects and even fatalities that medical authorities deemed were
due to the natural product.

Despite an initial move by the Drug Enforcement Agency in 2016 to attempt to issue a Schedule I classification on kratom which would ban its usage outright, there has been no successful federal legislation of this kind. As a result, local and state governments have been left to determine the best course of action regarding kratom laws and their citizens, including those in Georgia.

Kratom’s Growth In Georgia

Kratom’s arrival in Georgia happened online and coincided with the increase of its visibility across the United States via the Internet. From that point, word of mouth became another way that information spread to those interested in kratom in Georgia. Those who consumed the natural product were drawn to the fact that it appeared to help them to alleviate a variety of conditions, such as relief from chronic pain as well as help with weaning themselves off of addictions. Many Georgians that turned to kratom were hooked on opioids that were prescribed to them for different ailments.

More people were drawn to kratom as a result of increased exposure and soon physical retailers such as those running convenience stores and specialty shops with a focus on herbal supplements began to sell kratom products. State officials weren’t too enthused with this rise. This led medical authorities in Georgia to align themselves with the federal agencies about their views of kratom’s negative aspects, and they began to put together specialized toxicology tests for it.

Kratom Legislation In Georgia


Currently, kratom is still legal to purchase and possess in the state of Georgia. Concerns over its availability without any oversight among state legislators have manifested into a series of meetings held in various counties throughout Georgia to hear from those who kratom has benefited and those who are against the natural product.

This led to the state House to hold hearings in late 2018. It resulted in House Bill 551, which called for the regulation of kratom in the state. The bill was voted on and approved in the house and senate, and was signed into law by Governor Brian Kemp on April 26th, 2019. This legislation prohibits the sale of kratom to anyone under the age of 18, and offers regulation where there was none. Safety and legal kratom often go hand in hand, and Georgia is proof.
