Is Kratom Legal In Mississippi?

Mississippi has a contentious relationship with kratom, making it one of the more complicated states in which to purchase the plant. The attitudes toward kratom appear to be largely based on insufficient and potentially erroneous impressions of kratom on the part of the Mississippi Bureau of Narcotics.

Law enforcers and lawmakers alike seem to have been influenced to such a degree that they now believe kratom is essentially just an opioid in disguise, although the evidence for this is questionable. While kratom is legal at both the federal and state level, the local laws are changing to such a degree that anyone purchasing the plant in Mississippi may want to do their homework before buying kratom in Mississippi.

We’ll tell you more about the kratom laws in Mississippi, the cities and counties that have banned kratom, what exactly has prompted legislation, and how it’s likely to impact future legislation and attitudes in the state.

Classification of Kratom in Mississippi

Kratom is not currently classified in the state of Mississippi, meaning it is legal at a statewide level. However, many counties and cities in Northeast Mississippi have made it a misdemeanor to own or sell kratom. Outside of these designated places, it is legal to own and use kratom for consumers. Qualified merchants are also allowed to sell kratom in these areas.

It should be noted that there isn’t much regulation for kratom, something that has caused multiple problems for people who want to take the botanical. Current Mississippi Kratom Legislation

If you’re asking yourself ‘Is kratom illegal in Mississippi?’, you should know that some people definitely want it to be. House Bill 974 and Senate Bill 2475 were both originally proposed in 2018 to amend the state’s code and add kratom to the list of Schedule 1 drugs. However, the law was never passed.

If you’re wondering what’s driving the local legislation, look no further than the Mississippi Bureau of Narcotics. Spokesmen from the agency have stated that kratom has been linked to 12 deaths in the state, which has caused lawmakers to sit up and take notice. Others have stated that it’s an addictive and dangerous substance on the same par as opioids.

Of course, it should be noted that the proof for kratom having caused these deaths was never shown to the public, and no one has ever come out and said that kratom was the direct reason for the fatality. Even if the deceased was shown to have kratom in their systems, it’s unfair to claim that kratom caused the problem if it wasn’t the only possible culprit.

There’s an ever-growing list of places in Mississippi where the possession and sale of kratom has been addressed through local laws. Counties with specific laws on the books include Prentiss, Alcorn, Itawamba, Tippah, Tishomingo, Union, Lowndes, Monroe, Nuxubee, and Calhoun.

Cities and towns in Mississippi with kratom bans include Mantatchie, Belmont, Derma, Fulton, New Albany, Booneville, Calhoun. Marietta, Columbus, Okolona, Mantachie, Iuka, Guntown, Caledonia, Blue Mountain, Bruce, Burnsville, Corinth, Oxford, Pontotoc, Ripley, Vardaman, Saltillo, Senatobia, and Tishomingo in Mississippi.

As you can see, there’s some overlap in there, but it’s worth knowing whether your state and county banned it or just the county banned it. The level of awareness by law enforcers is ultimately just as important as the law itself. Considering kratom is still flying under the radar in terms of national recognition, it’s still something that not everyone knows about.

It’s worth noting that each of the Mississippi cities with kratom bans, has used its own process of banning kratom resulting in Mississippi laws on kratom that aren’t exactly clear. For example, Oxford, Mississippi officials voted against synthetic kratom in August 2019, citing safety concerns and the lack of regulation. There was a public hearing in which no one spoke either for or against kratom that was part of the procedural process. Stores were ordered to stop selling entirely or risk citation from police officers.

However, it’s not clear if the Mississippi lawmakers understood that synthetic kratom and natural kratom are not the same thing. Synthetic kratom may have all kinds of additives that make it unsafe for the consumer, while natural kratom has been used for hundreds of years in its native countries.

Buying and Shipping Kratom in Mississippi

There are reasons to be hesitant if you’re purchasing kratom anywhere in Mississippi. Some suppliers may be hesitant to sell kratom even in legal cities and counties. The buzz around the substance may put them under increased scrutiny — especially if anything happens to their buyers. So if you’re buying kratom powder, Mississippi is a place where discretion is advised to find it in legal cities and towns.

When it comes to shipping, employees of UPS, USPS, and FedEx are required to follow the federal guidelines on kratom, however, some people have reported delays if their package is processed in a location where kratom is illegal. These reports are rare, but worth noting, considering the proximity to Alabama, a state in which kratom is banned statewide.

Kratom Advocacy in Mississippi

There have been several advocate groups in Mississippi, despite the absence of supporters in certain public hearings. One major group is the American Kratom Association (AKA), an organization that has led the way in several states to educate consumers and legislators alike as to the realities behind kratom.

Like the vast majority of kratom supporters, the AKA fully supports the regulation of kratom to ensure public safety. However, they do not believe that kratom should be banned, especially considering the outpouring of praise from those who report the benefits of the plant.

The AKA state captain in Mississippi has urged supporters in Abbeyville, Meridian, Water Valley, Batesville, Holly Springs, and Pontotoc to follow the legislation and get involved whenever possible. Interestingly though, the AKA doesn’t seem nearly as involved in Mississippi as they have been in other states. This may be due to the strong attitudes of the people there.

Because the AKA faces some strong opposition in Mississippi, those who want to be involved should do so. In addition to the narcotics bureau, the other group that seems dedicated to banning the substance is the Lowndes County Crime and Addiction Task Force. They’re spreading their message everywhere they can. Local officials steadfastly believe that state legislators will soon back them up in outlawing kratom in the state, though it should be noted that advocates still have a chance to preserve current Mississippi laws.
