Nevada Kratom Laws

Mitragyna speciosa, or kratom as it’s widely known, has become a steady topic of conversation in American homes within the last decade. This natural product has been around since the middle of the 19th Century, originating in Southeast Asia as a traditional remedy for those who were in
search of relief for different health issues. Derived from the leaves of the tree, kratom proved to be highly popular for years even as authorities in the region cracked down on its use by the public.

Over time, word about kratom began to spread to other countries in Europe and then the United States. The initial wave of users caught the attention of the federal government, who had an abundance of questions concerning kratom and its safety. In 2016 there was a rash of cases of kratom users falling ill and a number of fatalities that compelled the Drug Enforcement Agency to attempt to ban the natural product through a Schedule I classification. But a significant protest from advocates in unison with a group of members of Congress who wanted more research done on kratom delayed those efforts.

As a result, the decision on what to do about kratom and its usage was left up to local and state governments.

Kratom’s Presence In Nevada

Those living in Nevada became aware of kratom online through its growing stature on the Internet at various websites that had it for sale. Intrigued, some people took the plunge to try the natural botanical product and were content with the benefits that they got from using it. Others who tried it also attested to it being an aid in their efforts to wean themselves off of prescription opioid medication that they received for various medical reasons. This helped to increase the demand among others in Nevada who wanted to try kratom for themselves.

In response, a wide range of shops, from gas stations to specialty stores with a focus on herbal supplements began to carry kratom for
sale. There were a few companies in that established themselves in Las Vegas selling kratom in bulk. As time went on though, law enforcement officials in the state were concerned about kratom as incidents nationwide saw some users poisoned along with the discovery of some
batches of kratom found to be impure due to being tainted with salmonella and metal in 2018.

This prompted some heavy discussions among Nevada state legislators who understood that kratom held a unique position in the state, and they sought out opinions from those who used it along with testimonies from medical researchers.

Kratom’s Legality In Nevada

Presently, kratom is now legal to consume, purchase and distribute in the state of Nevada. This is due to AB 303, a bill which was first introduced to the state assembly on March 18th, 2019. The bill, which had bipartisan sponsorship, details the regulation of kratom in Nevada with certain conditions.

Kratom is not to be sold to anyone under the age of 18, and it has to be implicitly labeled by those businesses that intend to sell the natural product to the
public. It also details that the fine for breaking any of these codes is $1000. AB 303 was approved by the governor on June 5th, 2019.

One of the most progressive of states when it comes to kratom, Nevada laws may set some significant precedence in the nation.
