Kratom Legality in Virginia

In the realm of natural products that are available as supplements, kratom may be a relative newcomer, but it has a long history. Originating in Southeast Asia, kratom is created from a tropical tree that has been lauded for centuries as a part of traditional medicine in the region. Its primary usage as an analgesic remedy was dispensed to patients in Thailand, Malaysia and Indonesia and was first noted by Western personages in the middle of the 19th Century. From that point, kratom was in consistent use even as legal authorities in those nations issued ordinances against it.

Kratom stepped onto the scene in Europe and America around 2010, thanks to its expanded availability on the Internet. The federal government began to notice occasional cases of some of those using kratom falling ill, which seemed to be occurring nationwide. This period, which saw a peak 
between 2014 and 2017, compelled the Drug Enforcement Agency to put forth a declaration that they would classify kratom as a Schedule I substance which would ban its usage nationwide. They backed off of that decision due to public outcry in conjunction with statements from members of Congress and medical researchers who wanted a longer period to further analyze the natural product, its uses, benefits and potential for harm.

Kratom’s Presence In Virginia

Residents in Virginia slowly began to take notice of kratom’s presence in the state due to its online presence. Word also spread among people in the state who were looking for alternatives to some medications that they were prescribed for certain conditions. A main factor that drew some to kratom were testimonials from users who felt that the natural product helped them to wean themselves off of addictions to prescribed opioid medications.

The demand led a few retailers who ran herbal supplement stores and convenience stores to make kratom available for purchase. Over a time period that spanned from 2013 until recently however, there have been a number of cases in Virginia that have seen users fall ill due to increased toxicity in their systems as a result of untested products. The state’s health department stated that since 2015, there were 26 deaths related to kratom. They did go on to
further elaborate that in all but three of these deaths, other substances were involved in these fatalities. This news hasn’t stunted the rise in usage across the state however, with more retailers making kratom available in select stores that sell CBD oils.

Kratom’s Legality In Virginia

Presently, kratom is legal to possess, purchase and distribute in the state of Virginia. The state’s public health department issued warnings along with background information on kratom and its usage earlier in 2019. There have been debates between those who are for the responsible usage of safe kratom in Virgina and those who want to see it classified as a Schedule I substance in accordance with the federal government’s recommendation back in 2016.

Groups have also petitioned members in the state legislature to consider regulation policies for kratom and those who would produce, sell and use it responsibly, and to date there has been no further movement among state politicians to make any changes in the near future.
