Is Kratom Legal In New Jersey?

New Jersey has had an interesting history when it comes to kratom. This natural plant has stirred up some controversy, but that controversy has never quite managed to extend to any kratom laws in the state. 

In fact, it doesn’t seem as though most lawmakers know very much about kratom at all, apart from one individual who has not stopped trying to ban it since 2015. His peers have seemed largely content to follow federal recommendations at this time. And so far, since the federal government has made kratom legal, New Jersey has been fine to do the same.

Classification of Kratom in New Jersey

As of now, kratom is not classified, which means it is legal to purchase and own the plant within the state. Qualified merchants are also allowed to make, sell, and distribute kratom within state lines. 

Current New Jersey Kratom Legislation

While there are no formal laws restricting the use of kratom in New Jersy, there have been several attempts to restrict use of the botanical. There is also pending legislation that would ban the plant in the state. 

In Assembly Bill 4431, a section was introduced that would make it a crime to manufacture, distribute, or own any part of the kratom plant. Those in possession of more than one ounce of kratom would be convicted of a crime in the third degree. Anything over one ounce would be a second-degree crime. This bill died sometime in 2015. 

In 2016, Assembly Bill 3281 was introduced with similar language to 4431. However, it only received about a quarter of the assembly's support and again died that same year. Both bills were introduced by Assemblyman Ronald Dancer who voiced his concerns regarding the potential for kratom abuse. 

In 2018, Assembly Bill 2865 was introduced to similarly ban kratom. This bill was referred to the Assembly Law and Public Safety Committee and appears to be pending 

While the bills haven’t received much support in the past, it helps to understand the general attitudes of legislators both at the state and federal level.  

Buying and Shipping Kratom in New Jersey

There have been no real reports of people having problems buying or shipping kratom to or from New Jersey. Organizations such as USPS, UPS, and FedEx are obliged to follow the federal government as opposed to state or local governments. 

That being said, if you’re buying kratom in New Jersey from a different state, you may want to be aware of the exact route your package will take. Some buyers have reported that if kratom goes through a banned state, their shipment is confiscated for further inspections. Again, officials are not supposed to do this, but may be unaware of the exact laws. These reports are rare, but worth noting before you buy. 

Some people have also reported that the number of places for buying kratom in New Jersey have been somewhat lacking. You may have a difficult time finding sellers in certain parts of the state. Of course, this would be true of plenty of other states where kratom in legal.

If you’re looking to buy kratom powder in New Jersey, it helps to find someone you know is trustworthy. Online reviews can be a great way to ensure that what you’re purchasing is pure kratom, so you know you’re taking something as safe as it is effective. 

Kratom Advocacy in New Jersey

Advocacy efforts have been underway in New Jersey, particularly by the American Kratom Association (AKA). The group has been monitoring all kratom laws in New Jersey and attempting to step in whenever needed. 

Because Assemblyman Dancer has only received so much support for his bills, the AKA doesn’t appear to be making New Jersey their top priority. In other words, the group likely believes that New Jersey kratom laws will remain intact because the pending bill will go the same as the other two bills that came before it. 

This group is entirely committed to spreading the truth about how kratom can help people and why it should be regulated rather than banned. Their efforts have been successful in a number of different regions, and there’s no doubt that they’ll turn their attention to New Jersey if and when they need to. 

New Jersey kratom laws have a lot to do with what people and doctors do in the state. While there hasn't been a lot of studies done about kratom, researchers at the National Institute on Drug Abuse have confirmed that kratom can affect the same receptors in the brain as opioids. It’s also not nearly as addictive
