Is Kratom Legal In South Dakota?

There are certain states in the country where kratom has received relatively outsized attention compared to others, but South Dakota isn’t one of them. Much like its neighbors, the plant doesn’t really seem to be getting any recognition, positive or negative, in SD.

Despite the DEA temporarily banning kratom on a national level, there are plenty of people who still don’t know what it is — and this includes both lawmakers and politicians.

This region appears to be a blank slate at this point when it comes to kratom laws in South Dakota, one that will likely only address the issue once it can no longer be ignored. Read on to learn more about the kratom legislation and laws of South Dakota, so you’ll have a better idea of what will happen in the future if and when kratom does make it to the top of the docket.

Classification of Kratom in South Dakota

There are no official classification laws for kratom in South Dakota. All people within the state are allowed to purchase, use, and distribute kratom as they see fit. Merchants are allowed to sell kratom to customers without restrictions.

Kratom is not regulated in the state of South Dakota, so residents are strongly encouraged to search for producers with excellent reputations within the kratom community and plenty of independent reviews. The plant can easily be mixed with other, more harmful compounds without the user knowing.

Current South Dakota Kratom Legislation

Is kratom illegal? In South Dakota, the answer is no.

In fact, there is no legislation about kratom at all. We’d be willing to bet that most people on the legislative body haven’t even heard of kratom, let alone have an opinion about it. Some sources claim that South Dakota kratom legality is being discussed in the state, but there’s really no evidence to support this.

If you’re looking to buy kratom powder South Dakota, you should know that all cities and municipalities are authorized to sell it. There are formal legislation or amendments anywhere in the state. However, it’s worth noting that kratom may be difficult to find, depending on where you’re located.

Buying and Shipping Kratom in South Dakota

There are plenty of places where you can buy kratom online, and for the most part, you should have no trouble doing this in South Dakota. Kratom is both legal at the federal and statewide level, and major carriers like UPS, USPS, and FedEx are required to put federal rules above all else.

The vast majority of people who buy kratom have not experienced problems with their shipments, so it doesn’t not appear to be a big problem.

Botanical Advocacy in South Dakota

One of South Dakota’s largest advocates is the American Kratom Association (AKA). This group keeps an eye on everything from legislation to misleading new stories to personal stories from users. If they feel the need to follow up on anything, such as proposals to a new law or a report that is sorely lacking in details, they find people who can step in.

So far, they’ve had a lot of success in helping people to reconsider their staunch views against kratom. In many cases, they’ve been able to successfully argue for regulation instead of out-and-out restriction. This group supports regulation of kratom in South Dakota and the nation at large. They want all buyers to feel confident in the product they’re taking — regardless of why they need it.

The AKA doesn’t appear to be that active in South Dakota though because, so far, there doesn’t seem to be a need. South Dakota kratom laws are simply not being discussed enough to warrant their efforts. However, it seems likely that if this changes, they will become more involved (and they’ll encourage other people to get involved too).
